Apple wants eight Samsung devices banned in the United States [Apple vs Samsung]

We knew it was coming and it has arrived. Apple has filed an official notice notifying the court that it is looking for a preliminary injunction on eight Samsung devices: Galaxy S 4G, Galaxy S2 AT&T, Galaxy S2 Skyrocket, Galaxy S2 T-Mobile, Galaxy S2 Epic 4G, Galaxy S Showcase, Droid Charge, and Galaxy Prevail. Of course Apple will have to wait until September 20 to convince Judge Koh that the sale of these eight devices should be banned in the United States, but at least we know beforehand what Apple is aiming at.

Those of you familiar with the Apple v Samsung verdict may notice Apple is looking for an injunction on only eight of the twenty-one devices that were declared guilty of infringement. This is primarily because of two reasons. Firstly, some of the twenty-four are no longer on sale in the United States so it would be a waste of Apple’s time and money to try to get them banned. Secondly, and more importantly, despite winning at trial, Apple still has to prove it has suffered “irreparable harm” because of these devices. Winning at trial does greatly help Apple’s cause but it isn’t a 100% assured victory. As such, I’m sure Apple feels it has a better chance of proving irreparable harm if it focuses on these eight devices rather than all twenty-four.

Samsung isn’t going to sit still for that September 20 hearing either. In what may be considered making the best out of a bad situation, Samsung will look to get the Galaxy Tab 10.1 injunction overturned seeing as the jury did not found the Tab 10.1 guilty of infringing on Apple IP.

Personally speaking, I feel Apple will break no sweat in getting an injunction against the eight devices in question. However, you never know what happens.
